Abstract
The proposals discussed in this article were implemented following publication. New York's then Governor Mario Cuomo proposed changes to the process by which children with disabilities secure educational rights. This article details the proposal from then Governor Mario Cuomo and outlines the positive and negative aspects of the proposed system. Furthermore, the article sets forth ideas for improving the system to provide the access to courts that is required to protect the rights of children with disabilities and to ensure impartiality of hearing officers.
